In Minnesota, a fourth-degree DWI is a misdemeanor and the lowest level DWI offense. It usually applies to first-time offenders and includes a blood-alcohol concentration below 0.16. The legal limit is 0.08.

Peterson is scheduled to appear in court at 9 a.m. on May 9.
